In Kenduwal village, Sandholi Panchayat, a dumping ground has been created since 2 years by the Municipal Council of Baddi right next to the houses where 5 Gujjar families reside. Today, these families met the SDM at Nalagarh to file a formal complaint about the intolerable living conditions created by this dumping and appeal for immediate action to relocate the dump. The SDM in response took the statement of the aggrieved parties and has said he will take suo-moto action in the matter.
In addition to the foul smell from the garbage which makes normal breathing difficult, children, elderly, and cattle frequently become ill because of the unhygienic conditions of the dump. “In the last 2 years, 20 cows and 4 buffaloes have died because of this dump” says Gulam Nabi from Kenduwal village. The gravest of all issues is that the path for commute (right of way) used by the 5 families having 30 members has been obstructed because of the dump.
In the recent days, due to rains, the path was submerged in obnoxious smelling mucky water due to the garbage dump and the issue was raised many times with the office of Municipal Council. The Municipal Council assured the families by saying that the path would be repaired. Nabi says “With great difficulty, on 6th July, the Municipal Council got a truck filled with sand to raise the path. After which another truckload of sand was needed to make the path better but in the meantime, garbage truck arrived and to prevent it from causing damage to the path, womenfolk tried to stop the garbage truck from advancing. Over this, the truck driver, garbage handling laborer got into a heated argument with us. They used foul language and did not pay heed to what we had to say which led to a clash between us. We want to make it clear to the administration that we do not have any issues with the laborers, but the dumping of tonnes of garbage in front of our homes is insensitive inhuman and that is what our complaint is about”.
Himdhara, which is working on environmental problems, has arrived at Baddi to do a fact finding on this issue. According to Manshi Asher, member of Himdhara, such dumping of urban waste is a gross violation of Environmental Protection Act. Based on the Act, in 2016, the Ministry of Environment, Forests and Climate Change has brought out the ‘solid waste management rules’. As mentioned in the rules, a solid waste dumping site has to be at least 200 meters away from place of habitation, also floodplains of rivers cannot be choses as dumping site either. It is also clearly mentioned in the Solid Waste Management Rules that the site of the landfill should be fenced and have a gate and the path inside should be made with concrete – the Municipal Council has violated this rule as well.
“Can you imagine how they’re living right next to dumping site as huge as 5 acres, how would anyone tolerate if the neighbour dumps their garbage right in front of your house?”, raised Asher.
The Gujjar community belongs to the Scheduled Tribe category in our country. They rear cattle which grazes on public lands and make a living by selling the milk. The complaint filed, which was submitted to the Superintendent of Police and the Pollution Control Board as well also states that “The Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act 1989” section 3 subsection 1 (b) states that in the vicinity of places of residence of people belonging to scheduled caste/tribe, disposing fecal matter, garbage, animal carcass or other obnoxious substances whereby unease is caused to them is a punishable offence. Officials not responding to complaints made by members of the SC/ST community are also flouting the law. “We are making a report on this and sending it to all administrative offices of the State as well as the Centre” said the members of Himdhara.
The Gujjars are not the only ones troubled. Since last 6 months, villagers from Malpur have complained about the dumping ground as well as the Common Effluent Treatment Plant also located in Kenduwal, due to the smell. It is shocking that the pollution control board hasn’t taken any steps yet, in this regard.

पर्यावरण संरक्षण कानून का घोर उलंघन: हिमधरा पर्यावरण समूह
केंदुवाल गाँव संधोली पंचायत में स्थित गुज्जर परिवार जिनकी बसाहट के ठीक बगल में बद्दी नगर परिषद् ने दो वर्ष पहले से कचरा डंपिंग ग्राउंड बना रखा है आज अपनी शिकायत ले कर एस.डी.एम्म बद्दी से मिले और ज्ञापन सौंपा जिसमें बताया कि नगर परिषद् की इस डंपिंग से कई लोगों का जीना दूभर हो गया है और यह पूरी तरह से गैर कानूनी है.
कचरे की बदबू की वजह से बेहद समस्या होने के साथ साथ, कचरे से बच्चों, बूढों और गाय भैंसों को बिमारियों का सामना करना पड़ रहा है. “पिछले दो वर्षों में हमारी 20 गाय और ५ भैंसें मर गयी हैं जिसकी रिपोर्ट हमने पशुओं के अस्पताल में भी लिखवाई है”, केंदुवाल के घुलाम नबीं ने बताया. परन्तु सबसे बड़ी बात यह है की वहां पर रहने वाले 5 परिवार के 30 लोगों का आने जाने का रास्ता इस कचरे की वजह से रुक गया है.
पिछले दिनों बारिश के कारण रास्ता बदबूदार कीचड़ से लबालब भर गया था और हमने इस बात की शिकायत बार बार नगर परिषद् के कार्यालय में की थी. नगर परिषद् ने हमें आश्वासन दिलाया कि रास्ते को ठीक करवा देंगे. नबीं ने बताया “बड़ी मुश्किल से इस रास्ते में 6 जुलाई को एक डम्फर मिटटी नगर परिषद् द्वारा फिक्वाई गयी. इसके बाद डम्फर को दोबारा और मिटटी दाल कर रास्ते का काम ख़त्म करना था पर यह होने से पहले ही कचरे के ट्रक डंपिंग साईट पर पहुँच गए और रास्ता फिर खराब ना हो इसलिए हमारे घर की महिलाओं ने उनको रोकने का प्रयत्न किया. इसके चलते ट्रकों को ला रहे मजदूरों और हमारे बीच बहस बाज़ी हो गयी. उन्होंने गाली गलौच की और हमारी बात मानने से इनकार किया. इसलिए गरमा गर्मी हो गयी. परन्तु हम प्रशासन को यह अवगत कराना चाहते हैं कि हमें मजदूरों के साथ कोई समस्या नहीं है – बल्कि नगर परिषद् के अमानवीय तरीके से काम करने पर और इस विशाल कचरे की डंपिंग से शिकायत है जो हम आपके सामने रखना चाह रहें हैं” . नगर परिषद् के EO श्री अजमेर सिंह को इस पूरी बात का पता होने के बावजूद उन्होंने गुज्जर परिवारों के तीन सदस्यों के खिलाफ पुलिस थाना बद्दी मेंFIR कर दी.
हिमधरा, जो की पर्यावरण के मुद्दे उठाने वाला एक स्वयं सेवी समूह है भी इस मामले पर फैक्ट-फयिन्डिंग करने बद्दी पहुंचा की सदस्या मांशी आशार के अनुसार शहर के कचरे को इस तरह से गिरानी ही पर्यावरण संरक्षण कानून का घोर उलंघन है. 2016 में इस कानून के अंतर्गत केंद्रीय पर्यावरण मंत्रालय द्वारा सूचित ठोस अपशिष्ट प्रबंधन (Solid Waste Management Rules – SWMR) की नियमावली बनाई गयी थी. इस नियमावली के अनुसार किसी भी disposal साइट को बसाहट से कम से कम 200 मीटर की दूरी पर होना चाहिए. साथ ही नदी के बाढ़ तट में भी नहीं स्वीकृत किया जा सकता है. SWMR 2016 में यह भी स्पष्ट है की किसी भी landfill site के बाहर गेट होना चाहिए और अन्दर से निकल रहे रास्ते कंक्रीट के होने चाहिए – इस बात की भी नगर परिषद् द्वारा पूरी अवहेलना की जा रही है.
“हमारे राज्य में गुज्जर समुदाय अनुसूचित जन जाती की श्रेणी में आते हैं और सामूहिक चारागाह ज़मीनों पर गाय भैंस चराने और दूध बेचने से से इनका व्यवसाय चलता है. “क्या आप सोच सकते हैं की ये 50 बीघा में फैले कचरे के ढेर के सामने कैसे रहते होंगे. क्या कोई भी यह बर्दास्त कर सकता है कि पडोसी अपना कचरा ला उनके घर के सामने डाले?” मांशी ने सवाल उठाया. अनुसूचित जाती एवं अनुसूचित जन जाती अत्याचार निरोधक अधिनियम 1989 के अनुभाग अनुभाग ३ में धरा 1.बी के अनुसार Sc/ST समुदाय के परिसर या पड़ोस में मल-मुत्र, कूड़ा-कचरा, पशुशव या अन्य घृणाजनक पदार्थ डाल कर उसे क्षति पहुँचना गैर कानूनी है. “सरकार और प्रशासन को यह नियम कानून पता होने चाहिए – और जो गैर कानूनी काम ये कर रहें हैं वो तुर्रंत बंद होना चाहिए. साथ ही, गुज्जरों पर लगे केस भी वापिस होने चाहिए. हम इस पूरे मामले पर एक रिपोर्ट तैयार कर सभी राज्य और केंद्रीय विभागों को भेज रहे हैं”, हिमधरा के सदस्यों ने कहा.
पिछले ६ महीनों से मलपुर गाँव के कई बाशिंदों ने कचरे के डंप की शिकायत की है. गौर तलब है कि प्रदुषण नियंत्रण बोर्ड द्वारा भी इस मामले में कोई कार्यवाही अभी तक नहीं करी गयी है. बोर्ड को भी आज गुज्जर समुदाय के लोगों ने ज्ञापन सौंपा और पुलिस थाणे में भी एक प्रति दी है.
