4 अक्टूबर 2018 को शिमला उच्च न्यायालय ने राज्य प्रदूषण नियंत्रण बोर्ड के वरिष्ठ पर्यावरण अभियंता को केंदूवाल स्थित बीबीएनडीए की डंपिंग साइट का निरक्षण कर वैधानिक कानूनों की अनुपालन के संबंध में अपनी रिपोर्ट दर्ज करने का आदेश दिया। यह आदेश केंदुवाल के प्रभावित लोगों द्वारा डंपिंग से स्वास्थ्य और जीवन पर खतरे को लेकर दायर की गई याचिका के आधार पर दिया गया था। साथ ही कोर्ट ने आदेश में यह भी कहा है कि अंतरिम अवधि में कोई गैरकानूनी डंपिंग नहीं की जाएगी।
मलपुर गांव के लोगों, जो कचरे के डम्प कि गन्दी बदबू से पीड़ित हैं, ने कोर्ट के आदेश का स्वागत किया और कहा ” आखिरकार जिम्मेदार अधिकारियों को जागना होगा और ध्यान देना होगा की किस तरह कानूनों की धज्जियां उड़ायी गयी हैं”। खुले में डम्पिंग के चलते पानी, मिट्टी और हवा का प्रदूषण तो हुआ ही है इसके साथ-साथ यह मक्खी, मच्छरों और अलग-अलग प्रकार के कीड़ों के लिये प्रजनन स्थल बन गया है। आसपास के गांवों में डेंगू, मलेरिया, टाइफोइड इत्यादि की घटनाएं लगातार बढ़ रही हैं। ग्रामिणों का कहना है कि “यह सब जिम्मेदार अधिकारियों की लापरवाही के चलते हुआ है जिन्होंने कचरे के वैज्ञानिक निपटारन करने की कोई सुध नहीं ली है”। पिछले 4 महीनों से स्थानीय लोगों ने कई अधिकारियों से गुजारिश की है कि इस डंप को हटा दिया जाना चाहिए और कचरा प्रबंधन संयंत्र , सिरसा नदी और कानून के अनुसार लोगों के निवास स्थान से दूर उचित जगह पर स्थापित किया जाना चाहिए। लेकिन अधिकारियों ने ग्रामिणों की मांगों पर कोई पहल नहीं की।
यह ध्यान देने की बात है कि बीबीएनडीए ने 2012 में इस साइट पर 9.70 करोड़ एकीकृत ठोस अपशिष्ट प्रबंधन सुविधा का प्रस्ताव केन्द्रीय पर्यावरण मंत्रालय को दिया था और 2015 में मंत्रालय ने इसके लिए मंजूरी दे दी थी। लेकिन पिछले तीन सालों से बीबीएनडीए ने संयंत्र स्थापित करने के लिए कोई कदम नहीं उठाया और ठोस अपशिष्ट प्रबंधन नियम 2016 के साथ-साथ पर्यावरण मंजूरी की शर्तों का उल्लंघन करते हुये कचरा डंप कर रहा है। प्रदूषण नियंत्रण बोर्ड के क्षेत्रीय कार्यालय ने 2016 में नगर परिषद प्रशासन को गैरकानूनी डंपिंग के लिये 6 कारण बताओ नोटिस जारी किये लेकिन आगे कोई कार्रवाई नहीं की गई।
“पिछले महीने, क्षति नियंत्रण मोड पर काम करते हुए, बद्दी अनगर परिषद ने केंडुवाल साइट पर मिट्टी की एक परत के नीचे कचरा दफनाया जिससे मिट्टी, भूजल और सरसा नदी को और ज्यादा प्रदूषित भी किया है” हिमधरा समूह, एक पर्यावरण समूह जिसने इस महीने के शुरू में इस मुद्दे पर एक बयान जारी किया था, ने कहा। साथ ही समूह का कहना है कि “हम उम्मीद करते हैं कि राज्य प्रदूषण नियंत्रण बोर्ड अपनी रिपोर्ट में प्रत्येक उल्लंघन की जांच करेगा – डंप की जगह; जो सिरसा नदी के बाढ़ के मैदान पर है, पानी, सतह के पानी, मिट्टी और क्षेत्र के लोगों के स्वास्थ्य और जीवन पर कचरे के प्रभाव”।
कचरे के खुले में डंपिंग का काम अवैध है क्योंकि यह ठोस अपशिष्ट प्रबंधन नियम, पर्यावरण संरक्षण अधिनियम, जल (रोकथाम और प्रदूषण नियंत्रण) अधिनियम के खिलाफ है। इसके अलावा, खुले में डंपिंग के चलते बुनियादी नागरिक अधिकारों; स्वच्छ वायु, जल और साफ पर्यावरण के अधिकार, का उल्लंघन हो रहा है। इससे पहले, नालागढ़ के एसडीएम ने कचरे के खुले डंपिंग के कारण सार्वजनिक परेशानी पैदा करने के लिए नगर परिषद बद्दी के खिलाफ सीआर पीसी 133 के तहत कार्यवाही शुरू की थी।

Kendulwal residents knock High court door on open dumping of municipal waste
Court orders Senior official of State Pollution Board to do site inspection and file report
The Shimla High Court on 4th October 2018 ordered the State Pollution Control Board Senior Environmental Engineer to visit BBNDA’s dumping site at Kenduwal and file its report with regard to its compliance with the statutory laws. The order was filed following an appeal by the affected persons from Kenduwal on the grounds that it was impacting their life and health. The court has also stated in its order that in the interim period no unlawful dumping would be carried out.
Residents of the Malpur village who have also been suffering from the obnoxious and fowl smelling garbage dump welcomed the order and said, “Atleast the responsible authorities will be forced to wake up and take notice of how the law has been blatantly violated”. The open dumping of garbage has resulted in contamination of the water, soil and air, and also, it became a breeding ground for mosquitoes, flies, various insects and rodents. The incidence of dengue, malaria, typhoid, etc. have been on the rise amongst the residents of the surrounding villages. “All of this is result of the sheer negligence on the part of Authorities who are entrusted with the responsibility of managing the waste properly in a scientific manner”, they said. Since the last 4 months the locals, have petitioned several authorities that the dump be removed and a proper waste management plant should be set up in an appropriate location, away from the Sirsa river and habitations of people as per the law. But the authorities had turned a deaf ear.
It needs to be noted that the BBNDA had proposed a 970 crore Integrated Solid Waste Management facility on this site in 2012 and got a clearance for the same in 2015. But for the last three years it made no move to set up the plant and was dumping in violation of the Solid Waste Management rules 2016 as well as the environment clearance conditions. The Regional office of the Pollution Control Board had served 6 Show Cause notices to the Municipal Council since 2016 but had taken no further action.
“Last month, acting on damage control mode, the Municipal Council of Baddi buried the garbage at the Kenduwal site under a layer of mud which not only prevented the previously accumulated garbage from getting treated properly, but has also contaminated the soil, ground water and the Sirsa River which flows just beside the site” said Himdhara Collective, an environment group who issued a statement on the issue earlier this month. “We expect that the State Pollution Control Board in its report will examine each and every violation – from the siting of the dump, which is on the Sirsa river floodplain to the impact of garbage on air, ground water, surface water, soil and the health and lives of the people of the area”, added the Collective.
The very act of open dumping of garbage is illegal as it goes against the Solid Waste Management Rules, Environmental Protection Act, Water (Prevention and Control of Pollution) Act, amongst others. Moreover, open dumping is also violating basic civic rights like Right to Health, Right to clean Air, Water and Environment. Earlier, the SDM of Nalagarh had initiated a Cr PC 133 proceeding against the Municipal Council Baddi for creating public nuisance owing to open dumping of garbage.
