Even as the IMD issued the ‘red warning’ for Kangra for the weekend massive floods were triggered in the streams flowing from the Dhauladhar ranges owing to the heavy rains in the region. While many residents had the safety of their shelter, others were not so fortunate. Like the migrant workers who have made Himachal their home for years but live shelterless in the state due to non implementation of housing schemes for the poor. “This is our third monsoon on the banks of the Manjhi khad. Every time it rains heavily our jhuggis are flooded and our children are at risk” says Nazuki, a member of Charan Khad Basti Punarwas Samiti.
Three years ago on June 16 and 17 of 2016 1,500 residents who had been staying in the Charan Khad slum near Dharamshala for over three decades were displaced without any rehabilitation. Most of these are migrants from Rajasthan and Maharshtra belonging to the Scheduled Caste and have been working as rag pickers, street vendors and daily wage labourers in the city over the years. Their children had been going to schools and colleges in the city and their education was disturbed by the displacement. The eviction was carried out on the grounds that the slum was a public hazard as our community was defecating in the open and that these were ‘inhuman settlements’. “Instead of providing sanitation facilities or proper housing overnight the newly formed municipal corporation threw these people on the streets in complete violation of basic human rights”, according to Sumit Mahar of Himdhara Collective, an voluntary action group based in Palampur. “We have been rendering our services to clean the city but the smart city has no provisions for us”, adds Dayanand, another member of the community.
It must be noted that crores of rupees have already been spent on the Integrated Housing Development Scheme initiated in 2008 in Dharamshala but no allotments have been made of the 300 odd dwellings that have been built. The community has already approached the National Human Rights Commission and has even deposed before the commissioner of the National Commission on Protection of Child rights given the deplorable conditions they are living in with no access to ration cards. Several high court and supreme court judgments have upheld people’s right to shelter and food in cities irrespective of their state of origin. So far the current government’s promise of Housing for all by 2022 does not seem to be close to being fulfilled. How many more monsoons will the people of Charan have to brave?

प्रेस नोट: 18 अगस्त 2019 : हिमाचल में बेघरों के लिये कोई उम्मीद नहीं
जिला कांगड़ा के लिये मौसम विभाग द्वारा बीते सप्ताह में ‘लाल चेतावनी’ जारी की गई थी। लगातार पिछ्ले 3 दिनों से हो रही भारी बारिश के कारण धौलाधार से निकले वाले खड्ड- नाले खतरे के निशान से ऊपर बह रहे हैं। जहां कई लोगों के पास अपनी सुरक्षा के लिये घर थे वहीं दूसरी तरफ कुछ लोग भाग्यशाली नहीं थे। उदाहरण के तौर पर प्रवासी मजदूर जिन्होंने कई वर्षों पहले हिमाचल प्रदेश को अपना घर मान लिया था लेकिन राज्य में बेघर- गरीब लोगों के के लिये किसी प्रकार की ठोस नीति या योजना के बिना घर के रहने के लिये मजबूर हैं। चरान खड्ड बस्ती पुनर्वास समिति की सदस्या नाजुकी ने बताया कि “मांझी खड्ड के किनारे यह हमारा तीसरा मानसून है। हर बार जब तेज बारिश होती है तो खड्ड का पानी हमारी झुग्गियों में भर जाता है और बच्चों के लिये खतरा बना रहता है “। 17 अगस्त को मांझी खड्ड में बाढ़ आने के कारण झुग्गियों को खाली करना पड़ा था कुछ झुग्गियों में पानी घुस जाने की वजह से लोगों का जरुरी सामान जैसे कपड़े, बर्तन, राशन आदि बह गया है।
तीन साल पहले 16-17 जून 2016 में धर्मशाला नगर निगम द्वारा चरान खड्ड बस्ती में 35 साल से रह रहे 290 परिवारों को बिना पुनर्वास किये उजाड़ दिया था। जिनमें से अधिकतर परिवार राजस्थान व महाराष्ट्र कि अनुसूचित जाति के हैं और धर्मशाला शहर में कचरा उठाने, मजदूरी करने व सड़क पर मनीहारी की दुकान लगाने के काम करते हैं। जिनमें से 50 परिवार विस्थापन के बाद धर्मशाला शहर से 10 किलोमीटर दूर मनेड़ पंचायत में मांझी खड्ड के किनारे किराया देकर झूग्गियों में रह रहे हैं।
चरान खड्ड से विस्थापितों ने अपने पुनर्वास व अन्य संवैधानिक अधिकारों की पैरवी करने के लिये समुदाय स्तर में ‘चरान खड्ड बस्ती पुनर्वास समिति’ का गठन किया है। यह समिति विस्थापन के बाद से ही पुनर्वास की मांग को लेकर पिछ्ले तीन वर्षों से विभिन्न सक्षम विभागों, आयोगों व अधिकारियों से पत्राचार व मुलाकात करते रहे हैं। इसके बावजूद नगर निगम प्रशासन व राज्य सरकार ने इन परिवारों के पुनर्वास के लिये अभी तक कोई सकारात्मक पहल नहीं की है। समिति के सदस्य भाऊ दास बताते हैं की ” पिछले तीन साल से हम लोग अपने पुनर्वास की मांग को लेकर जिला प्रशासन और नगर निगम के अधिकारियों से कई बार मिल चुके हैं लेकिन आज तक सरकार ने हम बेघर-गरीब लोगों के लिये कुछ नहीं किया है। प्रशासन हमें उजाड़ने का कारण बताता है की हमारी बस्ती एक ‘सार्वजनिक खतरा’ और ‘अमानवीय बस्तियां’ थीं “। पालमपुर स्थित सामाजिक कार्य करने वाले हिमधरा समूह के सदस्य सुमित महर बताते हैं कि “नव गठित नगर निगम ने इन लोगों को शौचालय व आवास की सुविधा देने के बजाय बस्ती को उजाड़ कर इन लोगों को बिना पुनर्वास दिये मानव अधिकारों का हनन करते हुये सड़क पर छोड़ दिया था”।
बहरहाल इस समय विस्थापित लोगों में से 45 लोग स्मार्ट सिटी धर्मशाला में सफाई कर्मचारी के तौर पर शहर की सफाई करते हैं। ध्यान देने वाली बात है की 2008 में तत्त्कालीन धर्मशाला नगर परिषद को सरकार की तरफ से ‘एकीकृत आवास और स्लम विकास कार्यक्रम’ के लिये 3.68 करोड़ रुपये का आवंटन हुआ था जिसमें 300 घर बनाये जाने थे। चरान खड्ड बस्ती पुनर्वास समिति के सदस्य राष्ट्रीय मानव अधिकार आयोग व राष्ट्रीय बाल सुरक्षा आयोग को भी अपनी दयनीय स्थिति व बिना राशन कार्ड के जीवनयापन करने की मजबूरी को रख चुके हैं। सर्वोच्च न्यायालय व अन्य न्यायलयों के ऐसे कई आदेश जिनमें बेघर लोगों के आवास के व जीवन के अधिकार को सुनिशिचत करने के लिये राज्य सरकारों को निर्देश दिये हैं। बहरहाल वर्तमान की केन्द्र सरकार ने वायदे किये हैं की देश में 2020 तक प्रत्येक बेघर परिवार के आवास का इन्तजाम कर लिया जायेगा चरान खड्ड से विस्थापित परिवारों की दशा देखकर नहीं लगता की वायदा इतने जल्दी पूरा हो पायेगा। और कितने मानसून में चरान के विस्थापितों को अपनी बहादूरी दिखानी होगी?
