Press Note, 13 February 2020, Thunag: Demands for effective implementation of FRA on ground gains momentum in Saraj valley.
The implementation of Forest Rights Act (FRA) has been laggard in the State of Himachal Pradesh owing to the bureaucratic lethargy and arrogance towards this law. A public meeting was organized in regard to this at Thunag on 13th February 2019 where Panchayat representatives, Gram Sabha Members, Forest Rights committee representatives and Women from Saraj Block, marked their participation. Since past 10 days, Members of Forest Rights Act Campaign for just and inclusive participation and Himdhara Environment Collective have been organizing FRA awareness meetings at panchayat level.
FRA , passed in 2006 by central government provides legal recognition to the rights of forest dependent communities by vesting in them Individual and Community Forest Rights under Section 3(1) and Development rights under Section 3(2). Bhagat Ram who is the Saraj Block convenor of FRA Campaign for just and inclusive participation, emphasized upon the vitality of FRA for people of saraj, speaking, “Our Saraj Valley is a geographically difficult and distantly located area where all people are dependent upon forest land for life and livelihood needs”
In past few years, the political apparatus and bureaucracy had finally shown some positive will towards implementation of section 3(2) of FRA, paving the road for basic development facilities to reach the area for the first time. Due to the development rights awarded under 3(2) of FRA, basic link roads reached many a villages in Saraj and many community centres, schools and PHCs were constructed.
But with the recent order of SC that bans the land transfer for development activities under 3(2) of FRA, all the ongoing and proposed developmental activities have come to a standstill. Even the funds received from user departments are now lying wasted in the light of this SC judgement. Speaking about the same, Prakash Bhandari from Himdhara Environment Collective shared the facts and figures from their recently published report on 3(2) highlighting, “The assumption by court that Forest land transfer under FRA is causing environmental destruction is groundless and false.” Adding further he said, “The scale of forest land transfer under FCA for big projects which involves felling of lakhs of trees can’t even match the forest land transfer under FRA for small developmental activities where the law itself mandates a maximum limit of 75 trees.”
What’s even more sad and worrisome is that amongst all this, the State bureaucracy instead of providing adequate information and training on FRA is misleading the public by spreading the rumor that FRA has been completely removed/ banned.
Sukhdev Vishwpremi from the same campaign on FRA stressed, “Already the state bureaucracy has been apathetically ignoring the Forest rights given under Section 3(1) of FRA but in Mandi, in the year 2014-16 instead of training and creating awareness among people about this act the District Administration has sent a nil report via Panchayat Secretaries saying there are zero forest rights claims.”
The forest dependent people of Mandi, since 2018, have been demanding to declare these nil claims as null and void and sending letters from their gram sabhas to DC demanding just and effective implementation of FRA.
Forest Rights Committee from saraj Block also met the SDM on 13th and submitted their memorandum to DC asking for immediate effective steps in ensuring the forest rights under 3(1).
In addition to this the people also submitted a memorandum via SDM to CM demanding the State government to take effective steps and advocate for the criticality of Section 3(2) in context of Himachal so that the court reviews its decision on the ban.
“Our lives are interwoven around forest land” adding to this Khem daasi, BDC Member Saraj block emphasized, “Development is our fundamental and constitutional right, even today only 23% villages in my region have access to proper roads”. Adding to this Sant Ram, Zila Parishad Member spoke, “It’s the duty and responsibility of government to ensure and protect our forest rights and forest dependent lives.”
The echoes of “jeevan ka ek aadhar, van adhikaar” surrounded the public meeting in Thunag demanding the just and effective implementation of both section 3(1) and 3(2) of Forest Rights Act.

2006 में भारतीय संसद द्वारा पारित वन अधिकार क़ानून (FRA) का क्रियान्वयन हिमाचल राज्य में अत्यंत ढीला व चुनोतिपूर्ण रहा है। इसी सन्दर्भ में 13 फरवरी 2020 को थुनाग में जन सभा बैठक का आयोजन किया गया जिसमें सराज विकास खंड के 10 से ज्यादा पंचायतों के प्रतिनिधि, वन अधिकार समिति सदस्य, महिला संगठन और ग्राम सभा के लोगों ने भाग लिया। बैठक का आयोजन, 10 दिन से सराज में चल रही वन अधिकार जागरूकता बैठकों के बाद, न्यायपूर्ण हिस्सेदारी के लिए वन अधिकार अभियान और हिमधरा पर्यावरण समूह द्वारा किया गया।
वन अधिकार क़ानून वनों पर निर्भर समुदायों को धारा 3(1) के तहत वन भूमि पर व्यक्तिगत व सामुदायिक उपयोग और संरक्षण का अधिकार और धारा 3(2) के तहत विकास का अधिकार प्रदान करता है। न्यायपूर्ण हिस्सेदारी के लिए वन अधिकार अभियान के सराज ब्लाक के संयोजक भगत राम जी ने जोर देते हुए कहा, “ हमारा सराज एक दुर्गम और दूर दराज पहाड़ी क्षेत्र है जहाँ लोग अपने जीवन और रोजमर्रा की जरूरतों के लिए वन भूमि पर निर्भर है. ऐसे में FRA, सराज की जनता के लिए बहुत ही महत्त्व रखता है”. गत कुछ वर्षों में प्रशासन और राज्य सरकार ने FRA कि धारा 3(2) के क्रियान्वयन को लेकर काफी सकरात्मक रवैया अपनाया था जिसके चलते सराज क्षेत्र में भी विकास की गति ने जोर पकड़ा था और कई गावं में पहली बार सड़क पहुंची तो कई पंचायतों में मूलभूत सुविधाओं का निर्माण शुरू हुआ।
लेकिन हाल ही में सुप्रीम कोर्ट ने FRA के तहत होने वाले विकास कार्यों के लिए वन भूमि हस्तांतरण पर हिमाचल में रोक लगा दी है जिसके चलते क्षेत्र के सभी विकास कार्य ठप्प पड़ गए हैं और यूजर विभाग से पंचायतों में आये फंड्स वापस हो गए हैं। इसी रोक के विषय में हिमधरा पर्यावरण समूह से प्रकाश भंडारी ने हाल ही में 3(2) पर प्रकाशित रिपोर्ट से तथ्यों को स्पष्ट करते हुए कहा कि, “यह अवधारणा कि FRA के तहत होने वाले हस्तांतरण से पर्यावरण को नुकसान होगा सरासर गलत है – स्थानीय परियोजनाओं के लिए FRA में हुए वन हस्तांतरण की तुलना बड़ी परियोजनाओं के लिए FCA में हुए वन हस्तांतरण – जिसमें लाखों की तादाद में पेड़ कटान होता है – से करना गलत है|” सबसे चिंताजनक बात यह है की इस सबके बीच में प्रशासन ने जनता के बीच यह भ्रम फैला दिया है की “कोर्ट ने FRA पर पूर्ण रोक लगा दी है”।
सभा में जिला स्तरीय समिति के सदस्य व जिला परिषद सदस्य सन्तराम ने उपस्थित जनता को विश्वास दिलाया कि वो वन अधिकार कानून को लागू करवाने के मुद्दे जिला स्तरीय समिति में पुरजोर शक्ति से बात रखेंगे।
न्यायपूर्ण हिस्सेदारी के लिए वन अधिकार अभियान से सुखदेव विश्वप्रेमी ने बताया कि, “पहले ही हिमाचल में FRA की धारा 3(1) को लागू करने में सरकार और प्रशासन ने कोई सकरात्मक कदम नहीं उठायें हैं, ऊपर से मंडी जिले में 2014-2016 के बीच जानकारी के अभाव में धारा 3(1) के तहत मिले अधिकारों को शून्य/निल कर दिया गया था.” मंडी की जनता 2018 से निल दावों को खारिज करने की मांग कर रही है और वन अधिकार दावा भरने की प्रक्रिया को अपनी अपनी ग्राम सभा में शुरू करने का प्रस्ताव जिला उपायुक्त को भेज रही है। सराज क्षेत्र से भी समस्त वन अधिकार समितियों ने 13 फरवरी 2020 को एस.डी.एम को धारा 3(1) के तहत वन अधिकार दावा भरने की प्रक्रिया को शुरू करने के लिए प्रस्ताव व ज्ञापन सौंपा।
साथ ही सुप्रीम कोर्ट द्वारा धारा 3(2) पर लगी रोक और वन भूमि को सीमांकन करने और RCC पिलर खड़ा करने के 4 नवंबर 2019 के निर्णय को लेकर सराज की जनता ने सुप्रीम कोर्ट व मुख्यमंत्री जयराम ठाकुर को भी मांग पत्र व ज्ञापन सौंपा और यह मांग की कि सरकार सुप्रीम कोर्ट में धारा 3(2) के तहत विकास के अधिकार को लेकर राज्य की जनता के लिए पैरवी करे ताकि कोर्ट अपने निर्णय पर पुनः विचार करे।
“वन भूमि पर हम पहाड़ी लोगों का जीना मरना टिका है”, यह कहते हुए खेम दासी जो बी.डी.सी सदस्य है और महिला मोर्चा अध्यक्ष, सराज मंडल ने जोर दिया कि “विकास हमारा संवैधानिक अधिकार है, आज भी सराज में मात्र 23% गावं तक ही पक्की सड़कें पहुंची हैं। ऐसे में सरकार का फ़र्ज है की सराज के लोगों के वन अधिकारों को सुनिश्चित करे”।
जन सभा में कलहड़ी, थुंनाग, भाटकीधार, शिवा थाना, च्यूनी, बनुगरेलचोक के पंचायत, महिला मंडल के प्रतिनिधियों के साथ सैकडों ग्रामीण मौजूद रहे।
