The Charan Khad Basti Punarwas Samiti today met Deputy Commissioner Kangra with an urgent appeal to arrange for the rehabilitation of 50 families living in shanties around the Manjhi river. This is the same community of daily wage workers who had been living for more than 35 years near Charan khad in Dharamshala. Exactly 4 years ago on 16th and 17th June 2016, this slum settlement was brutally destroyed by the local Municipal Corporation without providing any rehabilitation and resettlement, rendering close to 300 people homeless. The illegal eviction drive carried out at the onset of monsoons at Charan Khad left the entire community, women, children, differently able people, old and sick stranded on the street without any roof and shelter for more almost 10 days. Despite appeals and protests from members of the community, local citizens groups and concerned individuals the local administration and the state government failed to provide relief.
The community then went on to find shelter 10 km away from Dharamshala in Chetru Village, next to Manjhi stream where they set up the shanties for their temporary settlement as they awaited response from the authorities on their demand for housing. The High Court in its order 28/06/2016 had directed that the community may approach the concerned authorities with their grievances. Today 4 years have passed since they were forced out of their home in Dharamshala city. “In these four years we have approached every authority possible to grant us shelter but are yet to receive a positive response” said Raju, the Pradhan of Charan Khad Basti Punarwas Samiti.
With support from various organisations, 2 years ago 42 members of this community were employed by the Municipal corporation as Safai Karamcharis. “Even amidst the Corona crisis, while people stayed inside the comfort of their homes, we reported to work each and every single day to keep the city clean and livable”, he added.
In the wake of the monsoons, Himachal has declared a yellow alert and the Chief Secretary last week directing all DCs and Municipal Corporations to prepare an elaborate disaster management plan to deal with the predicted monsoonal calamities and ensure the safety of its citizens. “Our shanties at Chetru are on Manjhi river’s floodplain and highly risk. We have spent many monsoons sleepless, running for our lives, holding on to plastic sheets to keep a roof above our head to protect our children and elderly”, stressed Naazuki from CKBPS.
“Article 21 of the constitution grants every citizen the Right to Life and Shelter. Our central government has promised ‘Housing for All’ by 2022. Crores of rupees have been spent on the Integrated Housing Slum Development Programme. The government should account for these funds and provide shelter, free of any cost to the community displaced from Charan Khad”, added Sumit Mahar of Kangra Citizens Rights Group.
It needs to be noted that National Human Rights Commission has issued multiple notices on the matter to the MCD and the state government on the complaints filed by the CKBPS and KCRG. While some them have been provided with voter ids and ration cards, other still await these so that they may avail the welfare schemes meant for the poor. “During the Covid crisis and lockdown the government issued several statements asking migrant workers to stay back, continue contributing to the state’s economy and that they would be taken care of by the government. “Here are migrant workers who have been living here for decades and providing services to the city. Why is the Himachal government treating them like second class citizens?” added Mahar.

विस्थापन के 4 साल लेकिन आज भी छत को मोहताज धर्मशाला स्मार्ट सिटी को स्वच्छ रखने वाले कामगार!
चरान खड्ड बस्ती पुनर्वास समिति के सदस्यों ने आज उपायुक्त, काँगड़ा से मिल कर मांझी नदी के पास बस्ती में निवासरत 50 परिवारों का जल्द से जल्द पुनर्वास करने की मांग की | ये उसी समुदाय के लोग हैं जो करीबन 35 साल से ज्यादा धर्मशाला के चरान खड्ड में दिहाड़ी मजदूरी करके अपना जीवन व्यापन कर रहे थे| आज से ठीक 4 साल पहले 16-17 जून 2016, इस बस्ती को नगर निगम द्वारा बिना किसी वैकल्पिक पुनर्वास योजना के उजाड़ दिया गया था जिसके कारण करीबन 300 लोग बेघर हो गये थे | इस जबरन बेदखली की प्रक्रिया उस समय हुई जब मानसून सिर पे था और जिसके कारण 10 दिन से अधिक इस समुदाय के बच्चे, बूढ़े, महिलाएं और अपंग लोगों को बिना किसी छत के भारी मानसून में गुज़र-बसर करना पड़ा | इस समुदाय के लोगों, स्थानीय नागरिक समूहों, और चिंतित नागरिको के लगातार विरोध और अपीलों के बावजूद स्थानीय प्रशासन और राज्य सरकार से इन लोगो को कोई राहत नही मिली है|
पुनर्वास की मांग के साथ स्थानीय प्रशासन से सकारात्मक प्रतिक्रिया की उम्मीद बांधे इन लोगो ने धर्मशाला से कुछ 10 किमी दूर चैतडू गाँव में मांझी नदी की धारा के नज़दीक अपनी झुग्गियां अस्थायी रूप से बाँधी है | उच्च न्यायलय के 28.06.2016 के आदेश में यह स्पष्ट रूप से लिखा है कि इस समुदाय के लोग अपनी शिकायत लेकर किसी भी सम्बंधित अधिकारी के समक्ष जा सकते हैं | धर्मधाला शहर में उन्हें अपने घर से बेघर हुए आज 4 साल हो गये हैं | चरान खड्ड बस्ती पुनर्वास समिति के प्रधान राजू कहते हैं “इन 4 सालों में हमने हर सम्बंधित अधिकारी के समक्ष अपनी शिकायते रखी है और ज्ञापन सौंपे हैं लेकिन आज तक हमारे पुनर्वास के मुद्दे पर हमें किसी से कोई सकारात्मक जवाब नही मिला” |
2 साल पहले कई संस्थाओं की मदद से इस समुदाय के 42 सदस्यों को नगर निगम में सफाई कर्मचारी के पद पर नौकरी मिली | राजू आगे जोड़ते हैं कि “कोरोना संकट के समय जब पूरी दुनिया घर पर बैठ कर अपना बचाव् कर रही थी, हम हर एक दिन अपने घर से बहार निकल कर इस शहर की सफाई कर इसे जीने योग्य बनाते थे” |
मानसून के मद्देनज़र हिमाचल में येल्लो अलर्ट घोषित किया गया है और साथ ही पिछले हफ्ते मुख्य सचिव ने सभी जिलों के उपायुक्तों और नगर निगम को निर्देश दिए हैं कि वे पूर्वानुमानित मानसूनी आपदाओं से निपटने और नागरिकों की सुरक्षा सुनिश्चित करने के लिए विस्तृत आपदा प्रबंधन योजना तैयार करें | चरान खड्ड बस्ती पुनर्वास समिति की नाज़ुकी कहती हैं “चैतडू गाँव में हमारी बस्तियां मांझी नदी के पास हैं और ऐसे समय में हमारे लिए बहुत खतरा है | हमने कई मानसून बिना सोये गुज़ारे हैं, अपनी जान बचाते हुए, प्लास्टिक की शीट की छत के नीचे अपने बच्चो और बूढों को सुरक्षित रखते हुए” |
काँगड़ा नागरिक अधिकार समूह के सुमित कहते हैं कि “संविधान का अनुछेद 21 हर नागरिक को जीने और आवास का अधिकार देता है | हमारी केंद्र सरकार ने 2022 तक सभी से “हाउसिंग फॉर आल” का वादा किया है | इंटीग्रेटेड हाउसिंग स्लम डेवलपमेंट प्रोग्राम में करोड़ों का खर्चा किया गया है | सरकार को इन सभी नीतियों की तर्ज पर चरान खड्ड बस्ती के बेघर परिवारों को मुफ्त में आवास का अधिकार देना चाहिए” |
गौर करने की बात है कि चरान खड्ड बस्ती समिति और काँगड़ा नागरिक अधिकार समूह द्वारा दर्ज की गयी शिकायतों पर राष्ट्रीय मानव अधिकार आयोग ने नगर निगम और राज्य सरकार को कई बार नोटिस भेजे हैं | जहाँ कुछ लोगों को राशन कार्ड और वोटर कार्ड मोहैया हुआ है वहीँ काफी लोग अभी भी इंतज़ार में हैं और मूलभूत सुविधाओं से आज तक वंचित हैं | “कोरोना संकट और लॉकडाउन के समय राज्य सरकार ने कई घोषणाएं व स्टेटमेंट जारी करते हुए प्रवासी मजदूरों को राज्य में ही रुकने की हिदायत दी और राज्य की आर्थिकी में सहयोग देने पर सरकार द्वारा उनका ध्यान रखे जाने की बात कही | आगे जोड़ते हुए सुमित कहते हैं कि “यह प्रवासी मजदूर दशकों से यहाँ निवासरत हैं और इस शहर के लिए काम कर रहे हैं, ऐसे में हिमाचल सरकार इनके साथ द्वितीय श्रेणी के नागरिक जैसा व्यव्हार क्यों कर रही है?” |
