Coming down heavily on the Union Environment Ministry for introducing more than 30 amending notes diluting the provisions of the EIA Notification since the draft EIA 2020 was publicly rejected, 100+ civil society organisations and individuals wrote the Minister Mr. Prakash Javadekar asking him to accept and acknowledge the CSIR-NEERI report analysing the 20 lakh objections to the report and put in place a transparent and independent mechanism to identify and incorporate the comments received regarding the draft Notification.
In March 2020, the Ministry of Environment, Forest, and Climate Change published the draft Environmental Impact Assessment Notification 2020 which according to the majority of India’s citizens was considered a further dilution of the legally binding environmental safeguards. Over 20 lakh comments were sent to the Ministry to register the objections, improvements and implications of the proposed changes in the Environment Clearance Process for most industrial and infrastructural projects on the environment and society at large. The Ministry asked CSIR-NEERI to collate and compile the comments and objections for draft EIA 2020. The CSIR-NEERI report on collation of these comments which has been in the public domain since March 2021 pointed out that, “ there are genuine concerns from the stakeholders w.r.t. the above-mentioned clauses (but not limited to), which are supported by the important and critical recommendations of the expert committees constituted by the ministry, time to time and others, during the period after the EIA 2006 notifications.”
After going through this report in detail, over 100+ groups and individuals, today wrote to the Ministry to acknowledge and accept the NEERI report’s conclusion that there are serious problems with the EIA Draft 2020 and to urge the Ministry to also address gaps in the CSIR-NEERI report, and to ensure transparency and objectivity regarding MoEFCC’s next steps with respect to the draft EIA Notification 2020. (Letter attached at the end) The letter is signed by individuals and groups working on various issues related to the environment, many closely working with the communities most vulnerable to environmental pollution and disasters, and all who have been following the developments on environmental law, regulation and governance in India including the Draft EIA Notification 2020. Key recommendations mentioned in the letter are the following.
STOP BACK DOOR IMPLEMENTATION OF THE DRAFT EIA 2020 -Since the time the Draft EIA 2020 has been put out, MoEF&CC has from time to time been bringing out amendments to the EIA Notification 2006, that are the same or very similar to provisions in the Draft EIA 2020. This is nothing but a clear bypassing of the public comments process and a back door implementation of the provisions of the Draft EIA 2020. This practice must be stopped and provisions of the Draft EIA 2020 made effective only after properly considering and incorporating the public comments and other recommendations of the NEERI report.
ENSURE TRANSPARENCY ON THE WAY FORWARD – The Ministry should put in the public domain all the steps taken to date on moving further on the EIA Draft 2020, as well the steps it is planning or considering for the future. This should include the manner in which the comments are going to be processed further, the overall status of the steps taken and proposed for the draft EIA Notification 2020, a revelation of the Committees formed, etc.
INDEPENDENT COMMITTEE TO ANALYSE THE COMMENTS INCLUDE THE VULNERABLE POPULATION – The MoEF&CC should set up an independent committee headed or chaired by an eminent environmentalist to process and analyse the comments. Report by the committee should be made public. The Committee members should include not only experts representing different areas of environment and ecology but also key representatives of people bearing the brunt of the adverse impacts of projects and activities that impact the environment, as well as representatives of civil society who have been active in taking up issues of environmental impacts and their regulation and governance.
GO BEYOND SPECIFIC CLAUSES, USE THE RESEARCH – the Committee set up to examine the comments should go beyond specific comments and objections, and should consider the logic and rationale offered for these, and should provide its reasons including on the rationale while accepting or rejecting any comments.
MAKE ALL THE OBJECTIONS PUBLIC -We appeal to the MoEF&CC to put in the public domain the received comments, including the 6883 online comments which were with attachment and 1244 comments which were received offline through post to allow for analysis of these comments by the public.
INCLUDE ANALYSIS OF SUGGESTIONS ON OVERALL IMPROVEMENT OF THE EC PROCESS – comments collated and mentioned in the CSIR-NEERI report pertain only to the clause-wise provisions of the draft EIA Notification 2020 which means that comments, objections or suggestions regarding the broader overhauling of the EIA process in the country have been missed. It is important to analyse and discuss the suggestions on the broader strengthening of the EIA process such as those on the need for higher-level assessments, more effective Expert Appraisal Committees, capacity building, etc.

देश भर के 100 से भी अधिक पर्यावरण कार्यकर्ताओं और सामाजिक संगठनों ने पर्यावरण मंत्री प्रकाश जावडेकर को ज्ञापन भेजा. इसमें 2020 से विकास परियोजनाओं को पर्यावरण मंज़ूरी के EIA नियमों के लगभग ३० प्रावधानों को, जनता के पुरजोर विरोध के बावजूद, ढीला किया गया है. पत्र में सीएसआईआर-नीरी रिपोर्ट में दिए सुझावों को पहचानने और शामिल करने के लिए एक पारदर्शी और स्वतंत्र तंत्र स्थापित करने की मांग भी उठायी गयी.
मार्च 2020 में, पर्यावरण, वन और जलवायु परिवर्तन मंत्रालय ने पर्यावरण प्रभाव आकलन (EIA)अधिसूचना 2020 का मसौदा प्रकाशित किया. मसौदे में प्रस्तावित बदलावों को पर्यावरण के लिए खतरनाक और जन विरोधी बताते हुए कई नागरिकों, नागरिक संगठनों, पर्यावरण संस्थाओं, शोधकर्ताओं, अनेक विशेषज्ञों और राजनैतिक प्रतिनिधियों ने इसे खारिज करने की मांग की थी और अपने तरफ से सुद्र्ड पर्यावरण प्रभाव आंकलन के लिए कानून तैयार करने के लिए सुझाव भी भेजे थे. इन सुझावों में सरकार द्वारा प्रस्तावित मसौदे को कानूनी रूप से बाध्यकारी पर्यावरणीय सुरक्षा उपायों को और कमजोर करने वाला माना गया।
अधिकांश औद्योगिक इकाइयों और निर्माण परियोजनाओं के पर्यावरण और समाज पर पड़ने वाले असर को देखते हुए इस मसौदे में प्रस्तावित परिवर्तनों परआपत्तियों, सुधारों और निहितार्थों को दर्ज करने के लिए मंत्रालय को 20 लाख से अधिक टिप्पणियां भेजी गईं। मंत्रालय ने सीएसआईआर-एनईईआरआई नामक संस्थानों को ईआईए 2020 के मसौदे पर पायी गयी टिप्पणियों और आपत्तियों को संकलित करने का कार्य सौंपा था । सीएसआईआर-एनईईआरआई ने मार्च 2021 में अपनी रिपोर्ट को सार्वजनिक किया. रिपोर्ट में यह स्पस्ट रूप से दर्ज किया गया है कि, “उपर्लिखित धाराओं(पर उन तक सीमित नहीं) के सम्बंध में हितधारकों की चिंताएँ वाजिब हैं, जो 2006 के ईआईए नोटिफिकेशन जारी होने के बाद मंत्रालय द्वारा बनाई गई विशेषज्ञ समितियों की जरूरी अनुशंसाओं से मेल खाती हैं।”
इस रिपोर्ट को विस्तार से पढ़ने के बाद, सिविल सोसाइटी संगठनों और कार्यकर्ताओं ने मंत्रालय को सीएसआईआर-एनईईआरआई की रिपोर्ट के इस निष्कर्ष कि ईआईए ड्राफ्ट 2020 में गंभीर समस्याएं हैं को स्वीकार करने की अपील की है. सीएसआईआर-एनईईआरआई रिपोर्ट में भी जो कमियां हैं उनको दूर करने का आग्रह करते हुए ईआईए अधिसूचना 2020 के मसौदे के संबंध में पर्यावरण मंत्रालय के अगले कदमों में पारदर्शिता और निष्पक्षता सुनिश्चित करने की मांग उठायी गयी है । (पत्र अंत में संलग्न है) पत्र पर पर्यावरण से संबंधित विभिन्न मुद्दों पर काम करने वाले व्यक्तियों और समूहों द्वारा हस्ताक्षर किए गए हैं, जिनमें से कई पर्यावरणीय प्रदूषण और आपदाओं से प्रभावित समुदाय के साथ काम कर रहे हैं और जो भारत में पर्यावरणीय कानून, विनियमन और शासन खास कर मसौदा ईआईए अधिसूचना 2020 पर पैनी नजर बनाए हुए है। पत्र में उल्लिखित प्रमुख सिफारिशें निम्नलिखित हैं।
पारदर्शिता सुनिश्चित करें – पर्यावरण मंत्रालय को ईआईए ड्राफ्ट 2020 पर आगे बढ़ने के लिए अब तक उठाए गए सभी कदमों के साथ-साथ भविष्य के लिए योजना बनाने या विचार करने वाले कदमों को सार्वजनिक करना चाहिए। इसमें मसौदे पर आयी टिप्पणियों को शामिल करने का तरीका, ईआईए अधिसूचना 2020 के मसौदे के लिए उठाए गए और प्रस्तावित कदमों की समग्र स्थिति, गठित समितियों के बारे में सार्वजनिक जानकारी रहस्योद्घाटन आदि शामिल होना चाहिए।
टिप्पणियों का विश्लेषण करने के लिए स्वतंत्र समिति – मंत्रालय को टिप्पणियों पर विचार करने और उनका विश्लेषण करने के लिए एक प्रतिष्ठित पर्यावरणविद् की अध्यक्षता में एक स्वतंत्र समिति का गठन करना चाहिए। समिति की रिपोर्ट सार्वजनिक की जाए। समिति के सदस्यों में न केवल पर्यावरण और पारिस्थितिकी के विभिन्न क्षेत्रों का प्रतिनिधित्व करने वाले विशेषज्ञ बल्कि पर्यावरण को प्रभावित करने वाली परियोजनाओं और गतिविधियों के प्रतिकूल प्रभावों का खामियाजा भुगतने वाले लोगों के प्रमुख प्रतिनिधियों के साथ-साथ नागरिक समाज के प्रतिनिधियों को भी शामिल करना चाहिए जो पर्यावरणीय प्रभावों और उनके विनियमन और शासन के मुद्दों को लेकर सक्रिय है।
विशिष्ट खंडों से परे जाएं, अनुसंधान का उपयोग करें – टिप्पणियों की जांच करने के लिए गठित समिति को विशिष्ट टिप्पणियों और आपत्तियों से परे जाना चाहिए, और इनके लिए दिए गए तर्क पर विचार करना चाहिए, और किसी टिप्पणी को स्वीकार या अस्वीकार करते समय तर्क सहित इसके कारण प्रदान करना चाहिए।
ड्राफ्ट ईआईए 2020 के पिछले दरवाजे के कार्यान्वयन को रोकें – जब से ड्राफ्ट ईआईए 2020 को रखा गया है, मंत्रालय समय-समय पर ईआईए अधिसूचना 2006 में संशोधन ला रहा है, जो कि ड्राफ्ट ईआईए 2020 के प्रावधानों के समान या बहुत समान हैं । यह सार्वजनिक टिप्पणियों की प्रक्रिया को स्पष्ट रूप से दरकिनार करने और ड्राफ्ट ईआईए 2020 के प्रावधानों को पिछले दरवाजे से लागू करने के अलावा और कुछ नहीं है। इस गतिविधि को रोका जाना चाहिए और ड्राफ्ट ईआईए 2020 के प्रावधानों को सार्वजनिक टिप्पणियां और नीरी रिपोर्ट की अन्य सिफारिशों को शामिल करने के बाद ही प्रभावी बनाया जाना चाहिए ।
सभी आपत्तियां सार्वजनिक करें – हम मंत्रालय से अपील करते हैं कि प्राप्त टिप्पणियों को सार्वजनिक डोमेन में डालें, जिसमें 6883 ऑनलाइन टिप्पणियां जो संलग्नक के साथ थीं और 1244 टिप्पणियां जो डाक के माध्यम से ऑफ़लाइन प्राप्त हुई थीं, ताकि जनता द्वारा इन टिप्पणियों का विश्लेषण किया जा सके।
प्रक्रिया में समग्र इसी प्रकिया में सुधार के सुझावों का विश्लेषण शामिल करें – सीएसआईआर-नीरी रिपोर्ट में संकलित और उल्लिखित टिप्पणियां केवल ईआईए अधिसूचना 2020 के मसौदे के खंड-वार प्रावधानों से संबंधित हैं, जिसका अर्थ है कि टिप्पणियों, ईआईए को लेकर बताई गई आपत्तियों या सुझाव प्रक्रिया से छूट गए है। ईआईए प्रक्रिया के व्यापक सुदृढ़ीकरण पर सुझावों का विश्लेषण और चर्चा करना महत्वपूर्ण है जैसे कि उच्च-स्तरीय मूल्यांकन की आवश्यकता, अधिक प्रभावी विशेषज्ञ मूल्यांकन समितियाँ, क्षमता निर्माण, आदि।
